Have an Idea or Invention* Want to own the rights to that idea to produce or sell to a company* This is the step by step how to guide to writing and filing your own Patent without paying a lawyer thousands of dollars to do it for you.
This is a 20 video course (10 mins each) I downloaded from youtube and put in one place. The teacher of this course has degrees from MIT and Florida State. He is a registered patent agent holds a ton of patents and patents applications and even has a JD (law degree).
In this course his goal is to teach you how the patent process works what the misconceptions are about patents and how to write and apply for a patent on your own for as low a price as possible.
This course discusses provisional patents. It does not discuss non-provisional patents or how to search for your invention to make sure others havent already patented that same idea.
It is important to note that there are differences between a patent copyright trademark trade secret etc. Also note that a patent is not necessarily what you think it is. If you have a logo or slogan you want to protect that would be a trademark not a patent. If you have a fictional writing or software source code you want to protect that would be a copyright not a patent. If you have a cookie recipe you want to protect that would be a trade secret not a patent. Patents are for some processes and physical tangible inventions like scissors and engines.
A patent for an invention is the grant of a property right to the inventor issued by the United States Patent and Trademark Office. Generally the term of a new patent is 20 years from the date on which the application for the patent was filed in the United States. A patent gives the holder the right to exclude others from making using offering for sale or selling the invention in the United States or importing the invention into the United States.
What is granted is not the right to make use offer for sale sell or import but the right to exclude others from making using offering for sale selling or importing the invention. Once a patent is issued the patentee must enforce the patent without aid of the USPTO.
In short a Patent is a defendable presumption of the right to sole ownership of something which allows you to sue someone if they try to take ownership in anyway. The problem is that after you spend the money and time to get a patent it costs a lot of money and time to monitor whether or not someone is using your ownership rights and costs even more to sue them if you think they are at which point they will pay their lawyers to argue that it's not the same idea you have a patent for because your patent reads "a blue pair of scissors" and their product is clearly a green pair of snips. You get the point it's a nice thought to have a patent but you have to weigh the cost and effort of getting one with the protection you really get from holding one.
There are three types of patents:
1) Utility patents may be granted to anyone who invents or discovers any new and useful process machine article of manufacture or composition of matter or any new and useful improvement thereof;
2) Design patents may be granted to anyone who invents a new original and ornamental design for an article of manufacture; and
3) Plant patents may be granted to anyone who invents or discovers and asexually reproduces any distinct and new variety of plant.
